End User License Agreement (EULA) — SPARK SAGA

This EULA governs your use of the SPARK SAGA web and mobile application. It applies in addition to our Terms of Service; where the two conflict on licensing of the application software, this EULA controls. It includes the minimum terms required by the Apple App Store.

1. License Grant

DivuSpark LLC ("we") grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the SPARK SAGA application (the "App") on devices you own or control, solely for your personal, non-commercial use, subject to these terms and the App Store / Google Play rules.

2. Restrictions

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App except as permitted by law; (c) rent, lease, lend, sell, redistribute, or sublicense the App; (d) remove proprietary notices; (e) cheat, exploit, or use unauthorized tools to alter gameplay; or (f) use the App in violation of applicable law or our Terms of Service.

3. Ownership

The App is licensed, not sold. We and our licensors retain all right, title, and interest in the App and its content, including all intellectual property rights.

4. Apple App Store — Additional Terms

If you obtained the App from the Apple App Store, the following apply:

This EULA is between you and DivuSpark LLC only, not Apple. Apple is not responsible for the App or its content.
The license is limited to use on Apple-branded devices you own or control, per the App Store Terms of Service.
Maintenance and support are provided solely by DivuSpark LLC; Apple has no such obligation.
To the extent required, DivuSpark LLC is responsible for any product warranties, which may be refunded via Apple if the App fails to conform.
DivuSpark LLC is responsible for addressing product and legal (including IP and consumer-protection) claims relating to the App.
Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
You represent that you are not located in a U.S.-embargoed country and are not on any U.S. Government prohibited-parties list.

5. Third-Party Services

The App relies on Google Firebase (Authentication, Firestore) and Google Sign-In. Such services are governed by their own terms; we are not responsible for third-party services.

6. Virtual Items, Payments, and Future Changes to the App

6.1 Virtual Items

The App includes virtual currencies (✨ Glow, ☄️ Spark Score, 💎 Energy Core), virtual items (stones, powerups, cosmetic looks), and Season Pass progress (together, "Virtual Items").

In this version, Virtual Items are obtained only by playing, through daily rewards, and through promotional gifts. They are not sold for real money.
You acquire no ownership rights in Virtual Items. You are granted only a limited, personal, non-transferable, and revocable license to use them within the App under this EULA.
Virtual Items have no real-world monetary value. They cannot be exchanged for real money, goods, or any other value, and cannot be cashed out.
You may not sell, trade, transfer, gift, or grant third parties any rights in Virtual Items outside the App. Unauthorized trading is grounds for removal of the items and suspension of the account.
Virtual Items remain available for as long as your account exists and the App continues to be offered. If you delete your account, your Virtual Items are deleted with it and cannot be recovered.
Season Pass progress is limited to the duration of the relevant season; unclaimed rewards expire at the end of the season. Season start and end dates are shown in the App.
We reserve the right to change or remove the quantity, price, properties, and availability of Virtual Items in order to preserve game balance, fix defects, or prevent abuse. We will give reasonable advance notice of such changes.
Virtual Items obtained through cheating, exploits, software defects, or unauthorized tools may be revoked.

This section does not affect your mandatory consumer protection rights in your country of residence.

6.2 Payments and Future Changes

The App is currently free, contains no real-money purchases, subscriptions, or in-app purchases, and the premium Season Pass track is locked. If in-app purchases are enabled later, transactions will run through Google Play Billing (or the relevant store infrastructure), payment will be handled by the store, and distance-selling terms, pre-contractual information, and refund and withdrawal conditions will be provided separately before purchase.

DivuSpark LLC reserves the right to modify, add, or remove game mechanics, features, content, and monetization models — including, without limitation, advertising, in-app purchases, multiplayer, and leaderboards — in future updates. We will notify users of material changes by appropriate means (for example, in-app notice or an updated effective date). If paid features or in-app purchases are added later, applicable purchase terms and disclosures will be provided at that time, and where changes involve new processing of personal data, we will comply with applicable law and obtain any required consent before that processing begins.

7. Termination

This license is effective until terminated. It terminates automatically if you breach these terms. Upon termination, you must stop using the App and delete it. Provisions that by their nature survive (ownership, disclaimers, limitations of liability) survive termination.

8. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, DivuSpark LLC's liability is limited as set out in our Terms of Service.

9. Governing Law

This EULA is governed as set out in our Terms of Service, without prejudice to mandatory consumer-protection rights in your country of residence.
