SPARK SAGA (the "Game") is a single-player 2D skill game operated by DivuSpark LLC ("DivuSpark", "we", "our", or "us"), with its registered address at 30 N Gould St #65176, Sheridan, WY 82801, USA.
These Terms of Service ("Terms") govern your access to and use of SPARK SAGA on the web and mobile. By creating an account or playing the Game, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Game.
The license to use the Game software is described in our separate End User License Agreement (EULA).
You must meet the minimum age required to use the Game in your country (at least 13, or a higher age where local law requires). If you are a minor, you may only use the Game with the consent and supervision of a parent or legal guardian. See our Child Safety Standards.
You can play as a Guest (anonymous) or create an account using email + password or Google Sign-In. Apple Sign-In may be offered in a future version. You may later link a Guest account to a registered account.
You are responsible for keeping your sign-in credentials secure. Notify us at link@divuspark.com if you suspect unauthorized access. We are not liable for losses arising from your failure to secure your account.
You agree to provide accurate information (such as a valid email address) and keep it up to date.
SPARK SAGA is a single-player, light/spark/fire-themed skill game. You steer a spark, grow by collecting light, and complete levels without hitting obstacles.
It currently has no chat, no messaging, no user-generated public content, no marketplace, no multiplayer, no leaderboards, and no public profiles. Your personal best in endless mode is shown only to you; it is not published in any public ranking. If such features are added in a future version, these Terms and our Privacy Policy will be updated to describe any additional data processing, and any required consent will be obtained.
Your game progress (unlocked maps and levels, your personal best, your character and its form, your Glow / Spark Score / Energy Core balances, your stone and powerup inventory, and the cosmetics you own) is saved to your account so it can follow you across devices.
The Game is currently free. There are no real-money purchases, no subscriptions, and no in-app purchases.
The Game includes virtual currencies (✨ Glow, ☄️ Spark Score, 💎 Energy Core), virtual items, and a Season Pass, all earned solely by playing, through daily rewards, and through promotional gifts. The free Season Pass track is unlocked by playing; the premium track is locked in this version and is not offered for sale. These virtual items have no real-world monetary value, cannot be exchanged for real money, and cannot be transferred outside the Game; detailed terms are in section 6 of the End User License Agreement.
If paid features or in-app purchases are introduced in the future, we will provide updated terms and any legally required pre-contractual, distance-selling, and withdrawal/refund information before you can buy anything.
DivuSpark LLC reserves the right to modify, add, or remove game mechanics, features, content, and monetization models — including, without limitation, advertising, in-app purchases, multiplayer, and leaderboards — in future updates. We may also suspend the Game for maintenance. We will notify users of material changes by appropriate means (for example, in-app notice or an updated effective date), and where changes involve new processing of personal data, we will comply with applicable law and obtain any required consent before that processing begins.

The Game, including its software, art, design, branding, and the "SPARK SAGA" name and logos, is owned by DivuSpark LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to play the Game for personal, non-commercial use, as further described in the EULA. You may not copy, modify, or create derivative works of the Game, or use our trademarks, without prior written consent.
The Game is built on Google Firebase (Authentication, Firestore) and uses Google Sign-In. Your use of these services is also governed by Google's terms. We are not responsible for third-party services.
Our collection and use of personal data is described in our Privacy Policy and, for users in Turkey, the KVKK Aydınlatma Metni. Anonymous usage statistics in the Game are off by default and run only with your explicit consent.
You may delete your account at any time in Settings → Delete Account. This removes your saved data (see the Privacy Policy and Account & Data Deletion policy).
We may suspend or terminate your access, with or without notice, for a material breach of these Terms, for fraudulent, cheating, or unlawful activity, or where required by law.
Upon termination, your access to the Game ends and your data may be deleted (subject to retention described in the Privacy Policy). Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law survive termination.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT SAVED DATA WILL NEVER BE LOST.
Some jurisdictions do not allow the exclusion of implied warranties; to that extent, these disclaimers apply to the maximum extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DivuSpark LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE GAME.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
These Terms are governed by the laws applicable at DivuSpark LLC's place of establishment, without prejudice to mandatory consumer-protection rights that apply to you under the laws of your country of residence, including:
Where required by law, you may bring disputes in your country of residence.
We may update these Terms. For material changes, we will provide in-app notice before they take effect. Continued use after changes constitutes acceptance.
If any provision is unenforceable, the remaining provisions remain in effect.
These Terms are offered in English and Turkish. Both versions are intended to have the same meaning; in case of conflict, the version required by your local consumer law prevails.
